New Delhi: A Delhi court on Monday extended the stay on further investigation into Union Law Minister Kapil Mishra’s alleged involvement in the 2020 northeast Delhi riots until May 7.
The extension came after the court was informed that notices issued to some respondents on April 9 had not been served. Special Judge Kaveri Baweja passed the order during a hearing on a petition filed by Mishra, challenging a magisterial court’s direction for further probe against him.
Previously, on April 9, Judge Baweja had issued a stay on the investigation till April 21, and had also sent notices to Mohammad Ilyas, a petitioner in the case, and others, asking them to respond by that date.
Senior advocate P K Dubey appeared on behalf of Kapil Mishra, while Special Public Prosecutor Amit Prasad represented the Delhi Police.
The matter stems from an April 1 order by Additional Chief Judicial Magistrate (ACJM) Vaibhav Chaurasia, who observed that a cognisable offence was “prima facie” made out and warranted further investigation. The magistrate had noted that Mishra was present in the area at the time of the alleged offence and remarked that an additional inquiry was necessary.
The plea seeking registration of an FIR against Mishra was filed by Mohammad Ilyas, a resident of Yamuna Vihar, who alleged the minister's role in inciting the riots. However, the Delhi Police opposed the request, maintaining that Mishra had no involvement in the violence.
The case remains under judicial scrutiny, with the next hearing scheduled for May 7.
