Allahabad HC grants bail to rape accused, directs him to ‘marry the survivor’

New Delhi: The Allahabad high court directed a man, who is accused of rape, to marry the survivor within three months, The Wire reported.

The man, hailing from Rajasthan’s Sikar district, is also reportedly accused of sharing her photos online.

Granting bail, a single-judge bench of Justice Krishan Pahal said in the order on February 20: ‘A person’s right to life and liberty, guaranteed by Article 21 of the Constitution, cannot be taken away merely because the person is accused of committing an offence until the guilt is established beyond reasonable doubt’.

The accused met the survivor last year at a coaching centre for police recruitment exams.

The 23-year-old woman’s family alleged that the accused sexually assaulted her multiple times in February 2024.

Following her family’s complaint against the 26-year-old man in May last year, an FIR was registered charging him under IPC sections 376 (rape), 506 (criminal intimidation), and the IT Act.

Subsequently, he was arrested on September 21 and sent to jail, according to the report.

The man approached the Allahabad high court after Agra sessions court rejected his plea for bail.

The lawyer representing the survivor said that the man forced her into physical relationship promising a job in UP police department.

The man is also accused of extorting Rs 9 lakh from her by threatening to release videos of the assault.
