Aviation Ministry’s new rules state obstructions near airports must be demolished

New Delhi: Following the fatal Ahmedabad plane accident on June 12, the Ministry of Civil Aviation (MoCA) has announced new draft rules to ensure that structures near airports do not constitute a risk to aviation safety in the future.
The laws require owners of buildings or trees that obstruct an airport to demolish or lower their height as directed. The laws indicate that the owner must comply with the order within 60 days of receiving notice from the civil aviation authority.
The draft Aircraft (Demolition of Obstructions Caused by Buildings and Trees, etc) Rules 2025 was issued on June 18 and will become effective once published in the official gazette, TNIE reported.
The Ministry has encouraged the public to submit objections or suggestions within 20 days of the notification's publication. Responses can be addressed to the Director General of Civil Aviation.
The officer-in-charge of the airfield will report non-compliance to the District Collector, according to the notification. The district Collector is responsible for verifying that the demolition or trimming follows the order.
Owners can appeal orders to the First or Second Appellate Officer. Those who comply with the orders may seek compensation under Section 22 of the Bharatiya Yavujan Adhiniyam 2024.
The notification states that any new non-compliant constructions constructed after the notification are ineligible for compensation.
