SC refuses to hear plea seeking judicial probe into Pahalgam massacre
text_fieldsNew Delhi: The Supreme Court on Thursday blasted petitioner who sought a judicial probe into the Pahalgam massacre, asking him to be ‘responsible before filing such PILs’.
The apex court, refusing to entertain the petition, said the petitioner should have considered the ‘sensitivity’ of the issue before filing the plea.
‘Be responsible before filing such PILs. You have some duty towards your country also. This is the crucial hour when each and every Indian has joined hands to fight terrorism. Don't demoralise the forces. Look at the sensitivity of the issue,’ Justice Surya Kant reportedly said.
Responding to the petitioner, the court said that the task of the judges is to decide on disputes not to conduct probe.
The worst terror attack in recent years claimed 26 lives in Pahalgam's Baisaran valley.
Explaining the role of judges, the court said: ‘Since when have we acquired expertise of investigation? You are asking a retired Supreme Court judge to investigate. They can only adjudicate. Don't ask us to pass an order.’
Responding to the petitioner’s plea for direction to protect Kashmiri students studying outside Union Territory, the top court directed the petitioner to approach the concerned High Court.
Regarding the petitioner’s other pleas, the court asked: ‘Are you sure about the prayer you are making? First you ask a retired Supreme Court judge to probe. They cannot investigate. Then you ask for guidelines, compensation, then directions to press council. You force us to read all these things at night, and now you speak for students.’The terror attack carried out by two Lashkar-e-Taiba-linked outfit in Pahalagam raised tensions between India and Pakistan.
